Terms of use
These terms govern the use of WaveRider, the game at wave-rider.xyz, between you and the operator of WaveRider (“we”). They apply to everyone who plays, and in particular to anyone who publishes a track or hosts a room. By using WaveRider you accept them.
1. Scope
WaveRider has no user accounts. In addition to accepting these terms by use, you accept them expressly each time you publish a track or open a room. Two further documents form part of these terms: the copyright and reporting policy, which sets out how content is reported and removed, and the privacy page, which sets out what data WaveRider processes.
2. The service
WaveRider is a rhythm game that runs in the browser and is free to play. When you play on your own, the audio file you choose is analysed in your browser and is not uploaded. Other data, such as the generated road, lyrics searches and your scores, is exchanged with the server during play, as described on the privacy page.
Audio is uploaded only when you choose one of the following:
- publishing a track, which stores the song so that anyone with the link can play it;
- hosting a room, which stores the playlist’s songs so that the players you invite can play them.
3. What you may share
Permitted:
- your own recordings, productions and mixes, and remixes of your own work;
- music released under a licence that permits sharing it, such as a Creative Commons licence that allows redistribution, or a royalty-free licence whose conditions you meet;
- music whose rights holder has given you permission to share it;
- music in the public domain.
Not permitted:
- commercially released songs that you have bought or stream, unless you hold a licence to distribute them;
- recordings taken from YouTube, Spotify, radio or any other source you do not hold rights to;
- remixes, covers or edits of another person’s song made without their permission. A cover also requires the permission of the songwriter;
- any content that is unlawful in your country or in the Slovak Republic.
The same rule applies to everything else that other players can see: track titles and artwork, player names, room names and chat messages. They must be yours to use, lawful, and free of harassment, hate speech and any sexual content involving minors. Names and titles are passed through a word filter; the filter catches common obscenities only and does not replace this rule.
If you are unsure whether you may share a song, do not upload it. Each time you publish a track or open a room you confirm your agreement to these terms, and with it that the music complies with this section. You are responsible for any content you share and for the consequences of sharing content you had no right to share.
4. Uploads
You retain all rights in the content you upload. By uploading it you grant us a non-exclusive, royalty-free licence to store it, to process it for the purpose of the game (generating the road and computing the song’s audio fingerprint) and to stream it to the players you share it with, for as long as the content remains on the service. A published track remains for 30 days; a room song remains until it has finished playing. We do not use uploads for any other purpose and do not sell them.
Every upload is checked automatically by comparing its audio fingerprint against songs removed after a copyright report. A match is refused with the message “This track was found to be copyrighted and is therefore not permitted to be used.” Other uploads are published without prior review and are removed when a valid report shows that they should be. The copyright and reporting policy describes the reporting procedure, what happens after a removal and how to object to one.
You may delete a published track yourself from the browser you published it in. Deleting it removes the audio from the server.
5. Fair play
Scores must be achieved by playing. You may not submit scores using bots, modified clients or altered game data, interfere with other players’ rooms, or send automated requests that burden the service. We may hide scores and names that violate this section and refuse the requests behind them.
6. Rooms
A room consists of a host and up to 7 further players who play the same playlist together. The host is responsible for the songs in the playlist and, by opening the room, confirms that they comply with section 3. Chat messages are relayed between players and are not stored, so they cannot be reviewed afterwards. The host may remove any player from the room at any time. Room names and player nicknames are visible to others and may be reported under the copyright and reporting policy.
7. Audius and LRCLIB
Songs from Audius are streamed from Audius under its Open Music License and are not uploaded to WaveRider. They were uploaded to Audius by their artists, and Audius decides whether they remain available, so a song may become unavailable on WaveRider without notice. Audius’s own terms govern the music itself.
Synced lyrics come from LRCLIB, a community-maintained lyrics database. WaveRider searches it when you choose lyrics for a song and shows the result to you only; it does not store lyrics or share them with other players. We do not control or check LRCLIB’s content, and lyrics may be missing, inaccurate or out of time with the music.
8. Moderation
Uploads, names and rooms are not reviewed before they go live. We act on reports sent to copyright@skurcak.eu and on violations we notice ourselves. The measures available to us are deleting a track together with its audio, hiding a score and the name attached to it, and adding a removed song to the upload blocklist. Rooms close when the host leaves. A person makes each of these decisions; the fingerprint check at upload is the only automated decision.
Because there are no accounts, we cannot ban individuals or notify an uploader whose track has been removed. If we have removed content of yours and you disagree, you may object by email; the copyright and reporting policy explains what to include.
9. Age
WaveRider has no accounts and collects no personal details, so there is no age verification. If you are under 16, obtain a parent’s or guardian’s consent before publishing a track or hosting a room.
10. Warranty and liability
WaveRider is provided free of charge and as is. We do not warrant that the service will be available without interruption, that a track will remain available for the full 30 days, or that any feature will remain unchanged. We may change, suspend or discontinue any part of the service at any time.
You are responsible for the content you share. If a third party raises a claim against us because of content you uploaded, you will bear the resulting costs. In all other respects we exclude liability to the extent permitted by applicable law. Nothing in these terms limits the rights granted to you by mandatory consumer protection law in your country of residence.
11. Changes
We may amend these terms. The date at the end of this page shows the current version, and changes that affect players are announced in the devlog. Continued use of WaveRider after a change constitutes acceptance of the amended terms.
12. Law and disputes
These terms are governed by the law of the Slovak Republic, and the courts of the Slovak Republic have jurisdiction over disputes arising from them. If you are a consumer resident in another member state of the European Union, the mandatory consumer protection rules of your country of residence continue to apply, and you may bring proceedings in the courts of that country. Please contact waverider@skurcak.eu before taking any formal step; most matters can be resolved directly.
